John Waller AI Terms

These AI Terms (the "AI Terms") are between John Waller ("John Waller," "I," "me," or "my") and you. If you are agreeing on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that entity. In that case, "you" refers to that entity.

These AI Terms are incorporated into my Terms of Use for www.thejohnwaller.com (the "Terms of Use"). If there is a conflict between these AI Terms and the Terms of Use, these AI Terms control for the use of AI Features.

"AI Features" means any feature or functionality on the Site that is identified as using artificial intelligence. Your access to AI Features is provided under the same general conditions as the Site in the Terms of Use and the Privacy Policy. You are responsible for using AI Features in compliance with all applicable laws and with any posted rules or acceptable use guidelines on the Site.

You may provide prompts, images, materials, files, or other content to the AI Features ("Input") and receive images, text, code, materials, files, or other content generated in response ("Output").

As between you and me, you retain all right, title, and interest in and to your Input and Output.

I and my licensors retain all right, title, and interest in and to the Site and AI Features, including improvements, enhancements, and new features.

You are responsible for securing and maintaining your rights to any third-party materials contained in your Input and for ensuring your Input does not violate the rights of others.

I may route Input and Output through third-party AI model providers and infrastructure vendors. These providers process your Input to generate Output and may temporarily retain logs for safety, abuse prevention, and debugging. I take reasonable steps to select reputable providers, but I do not control their systems.

Do not submit sensitive, confidential, or regulated data unless you have a lawful basis and you understand the risks. See the Privacy Policy for more details on data handling.

Unless otherwise stated on the Site, I do not use your Input or Output to train my own models beyond what is necessary to provide and improve the AI Features, operate the Site, and enforce policies.

Third-party AI providers may use de-identified data for safety or quality purposes consistent with their published policies.

If you require a stricter data handling arrangement, contact me to discuss alternatives before using AI Features.

Output is generated by artificial intelligence. Output may be inaccurate, incomplete, offensive, or otherwise unsuitable. Output is not reviewed for accuracy and does not represent my views. I make no warranty or guarantee as to the accuracy, completeness, reliability, legality, or usefulness of any Output.

You are solely responsible for evaluating Output for your use case, including human review, fact checking, and obtaining any needed permissions or clearances. Do not rely on Output as legal, medical, financial, or other professional advice.

You agree that you will not use AI Features to:

• Violate laws or third-party rights.
• Generate or disseminate malware, harmful code, or attempts to gain unauthorized access.
• Create or distribute content that is illegal, exploitative, or intended to cause harm.
• Infringe intellectual property or privacy rights.
• Misrepresent generated content as created by a human where disclosure is required by law or platform rules.

I may suspend or terminate access to AI Features for violations.

If you provide feedback, suggestions, or ideas about AI Features ("Feedback"), you grant me a worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable license to use the Feedback for any lawful purpose. Do not provide Feedback you wish to keep confidential.

AI Features may be offered as beta or experimental. Such features may change, break, or be withdrawn. To the extent permitted by law, they are provided "as is" and "as available," and any additional beta terms posted on the Site apply.

To the fullest extent permitted by law, AI Features are provided "as is" and "as available." I disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. I do not warrant that Output will be accurate or that AI Features will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, I will not be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits, lost revenue, or data loss, arising out of or relating to AI Features or Output. My total liability for any claim relating to AI Features will not exceed the greater of one hundred U.S. dollars (100 dollars) or the amount you paid to me specifically for AI Features in the twelve months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

You are responsible for:

• The lawfulness and accuracy of your Input.
• Your evaluation and use of Output, including compliance with laws and third-party rights.
• Implementing human review, testing, and safeguards appropriate to your use case.
• Notifying me if you believe an Output or model behavior violates law or rights.

I may update these AI Terms in the same manner I update the Terms of Use. I will post the updated date at the top of this page. Your continued use of AI Features after changes are posted constitutes acceptance of the updated terms.

Capitalized terms not defined here have the meanings in the Terms of Use or the Privacy Policy. References to the "Site" mean www.thejohnwaller.com and related pages or services where AI Features are available.
